By entering and using the website of THE CONTROLLER, THE OWNER expressly accepts and consents to the processing of their personal data in accordance with the terms and conditions contained in this PRIVACY POLICY, so If THE OWNER, do not expressly and completely accept the terms and conditions of this policy, you must refrain from providing any type of personal data to THE CONTROLLER by electronic or written way.
THE CONTROLLER follows the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility in the processing of the personal data of THE OWNERS, besides, THE CONTROLLER maintains administrative, technical and physical security measures that permit to protect personal data against loss, alteration, destruction or unauthorized use, access or processing. THE CONTROLLER do not adopt security measures less than those that they maintain for the management of their information.
We use your personal information for the following purposes:
The personal data that we collect from you, we will use for the following purposes that are necessary for the service requested:
  • The personal data collected will be used to carry out the primary and necessary activities related to the fulfillment of the obligations deriving from the contractual and / or commercial relationship between the client and THE CONTROLLER;
  • To generate a file of the client and / or provider, in order that THE CONTROLLER can provide the contracted services; and
  • Comply with the current regulations on civil protection, as well as with the Internal Programs of Civil Protection and the policies on physical security for access to the facilities, offices or branches of THE CONTROLLER, such as video surveillance systems and access to facilities.
We inform you that THE CONTROLLER has video surveillance systems inside and outside their offices. The personal data, images and sounds obtained through the video recordings, photographs, registers or access log to our facilities are treated with the following purposes:
  • Control of entry and exit of people;
  • Surveillance; and
  • Security, during your visit to our facilities.
In accordance with article 11, second paragraph of "Ley Federal de Protección de Datos personales en posesión de particulares", The Personal Data collected through video records and/or photographs will be kept for a period of 60 (sixty) calendar days in electronic media, personal data obtained through registers, logs or access formats to the facilities, will be kept for a period of 1 calendar month. Once the purpose of registration has been completed, they will be discarded in order to avoid illegal treatment.
THE CONTROLLER, informs that the patrimonial and financial data that are collected have the purpose to fulfil the legal relationship between THE OWNER and THE CONTROLLER; so they update what is established by article 10 and 37 of "Ley Federal de Protección de Datos personales en posesión de particulares".
What personal data will we collect for these purposes?
We will collect the following personal data:
  • Identification data;
  • Company name;
  • Name of the Proxy of the Company;
  • Public Deed with the faculties of the Proxy;
  • Tax number;
  • Nationality;
  • Address;
  • Personal phone;
  • Cell phone; and
  • Email.
THE CONTROLLER, informs that we will not collect sensitive data, such as personal data that affect the intimate sphere of THE OWNER, or whose improper use could give rise to any type of discrimination or caries a serious risk for THE OWNER such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, union affiliation, political opinions, sexual preference.
With whom do we share your personal data and for what purposes?
THE CONTROLLER compromise to ensure for the fulfillment of the principles of protection of Personal Data established by the Law and to adopt the necessary measures for their application, as well as to require their fulfillment with the natural or legal persons to whom we share or transfer the collected data, in order to give you an adequate service.
In other hand, THE OWNER accepts and grants his authorization for THE CONTROLLER to transfer their Personal Data to third parties, without it being necessary to obtain their consent again when the transfer is located in some of the following cases:
  • Is provided for in a Law or Treaty in which Mexico is a party;
  • Is necessary to safeguard the health of THE OWNER, among which are, prevention or medical diagnosis, provision of health care, medical treatment or management of medical services;
  • Is made to holding companies, subsidiaries or to companies that are under the control of THE CONTROLLER, a parent company or a company of the same group of THE CONTROLLER that operate under the same processes and internal policies;
  • Is necessary because of a contract entered into or to be celebrated in the interest of THE OWNER;
  • Is necessary or legally required for the safeguarding of a public interest, or for the procuration or administration of justice;
  • Is necessary or legally required for the recognition, exercise or defense of a right in a judicial process; and,
  • Is necessary or legally required for the maintenance or fulfillment of a legal relationship between THE OWNER and THE CONTROLLER.
THE OWNER is informed about the national transfer of his / her personal data, to the extent that it is necessary as well mentioned above, to the affiliates or subsidiaries of THE CONTROLLER For any information or doubt about the procedure, THE OWNER will be able to contact THE CONTROLLER by sending an email to the email address rh@tlwfreightmexico.com, in the hours and work day handled by THE CONTROLLER.
How can you access, rectify or cancel your personal data, or oppose its use?
You have the right to know wich personal data we have about you, for what do we use them and the conditions of use that we give them (Access). Also, it is your right to request the correction of your personal information if it is outdated, inaccurate or incomplete (Rectification); that we remove it from our records or databases when it considers that it is not being used properly (Cancellation); as well as oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.
To exercise any of the ARCO rights, THE OWNER, by himself or through his accredited Proxy, may exercise the ARCO Rights granted by the LFPDPPP in front to THE CONTROLLER, presenting an ARCO application to the THE CONTROLLER at the address located at Avenida Adolf B. Horn number 1737, interior 1, Colony Lomas del Curiel, Tlaquepaque city, Jalisco, Mexico, ZIPE CODE 45599 The ARCO application must be signed by THE OWNER or his representative, in order that THE CONTROLLER can carry out the authentication of THE OWNER that requires exercising their ARCO rights, in addition to the writing must be the following documentation:
  1. A copy of the Constitutive Act of the Company;
  2. A copy of the Public Deed stating the powers of the Proxy;
  3. A copy of the Proxy’s identification.
The application must specify punctually the ARCO rights and the personal data of THE OWNER. Once the document has been delivered, THE CONTROLLER shall notify THE OWNER within a maximum period of 20 (twenty) working days from the date on which it receives the request for an exercise of ARCO's right, the response to its request for access, rectification, cancellation or opposition. THE CONTROLLER shall notify THE OWNER the result of the resolution shall be effective within 10 (ten) working days following the date on which the response is communicated.
For any information or doubt about the exercise of ARCO rights, THE OWNER may contact THE CONTROLLER by sending an email to the email address rh@tlwfreightmexico.com, or telephone (33) 3914-6420 in the hours and working days that THE CONTROLLER manages.
How can you limit the use or disclosure of your personal information?
THE OWNER may request the update or limit the use or disclosure of your Personal Data, at any time by sending an email to the address rh@tlwfreightmexico.com, where you can clarify what Personal Data you want to update or want to leave to be treated by THE CONTROLLER, and if is necessary inform your desire that the Personal Data provided be no longer used for the fulfillment of the purposes described in this POLICY OF PRIVACY. To exercise this right must follow the procedure referred to in the chapter " How can you access, rectify or cancel your personal data, or oppose its use", without prejudice to the foregoing, THE OWNER may at any time, revoke the authorization granted for the processing of your Personal Data in accordance with the purposes indicated, through a request to the email address rh@tlwfreightmexico.com, THE CONTROLLER has in its operation, the necessary administrative, physical and technical security measures and sufficient for the protection of your Personal Data; However, if deemed necessary, it may implement additional measures that are within its reach to prevent the loss, wrong use, alteration, unauthorized access or theft of Personal Data provided by THE OWNER in accordance with the provisions of the LFPDPPP and its Regulations.

Applicable Law and Jurisdiction.
THE CONTROLLER and THE OWNER, express that the present POLICY OF PRIVACY, will be ruled by the legal provisions applicable in the Mexican Republic, specifically according to the "Ley Federal de Protección de Datos personales en posesión de particulares" and their respective Regulations, as well as the conducive regulations.
In the event that the parties fail to reconcile their interests related to the interpretation, execution derived from the obligatory content of the POLICY OF PRIVACY or any controversy derived from it, the controversy is submitted to the jurisdiction of the Federal Administrative Authorities or Federal Courts in the State of Jalisco, expressly renouncing any other jurisdiction that for reasons of their present or future domicile corresponded.
